We celebrated a huge victory for our state this week with the passage of the "Automatic Stay" bill. As explained below, the bill "restores the integrity of project appeals process, and reserves it for legitimate, well-founded complaints. It will also ensure that those complaints be heard and ruled on in a timely manner as to avoid unnecessary delays for permitted, regulated projects."

State Flag Study Committee

A resolution to create the State Flag Study Committee to propose an official, uniform design for the state flag based on historically accurate details and legislative adoptions.  Membership of the committee will include 5 members: the Directors of the Departments of Archives and History, and the Administration. One member appointed by the President Pro Tempore, One member by the Speaker of the House and One member appointed by the Governor.

 

Teacher Appreciation

 A bill to provide certain public school faculty members annually may receive payments for unused annual leave and sick leave in excess of ninety days. 

 

Deployment Property Tax Extension

This bill requires counties to offer property tax extensions to a taxpayer serving with the U.S. Armed Forces or National Guard in or near a hazard duty zone. The extension runs from the date of deployment until 90 days after their return. No interest may be charged until after the 90-day timeline lapses. 

 

Accommodations and Hospitlity Tax

A bill to allow a political subdivision to spend state and local accommodations tax and local hospitality tax revenue for the control and repair of flooding and drainage at tourism-related lands or areas. Amendments prevent the taxes from being spent on litigation costs related to those projects and only on flood control and drainage if the flooding relates to sea-level rise.

Execution Method 

A bill to provide that a person convicted of a capital crime and has a death sentence imposed shall suffer the penalty by electrocution or at the election of the person lethal injection if available.  This bill changes the default method to electrocution and only allows an election of lethal injection if the drugs are available.

Animal Facilities

This bill establishes specific requirements for the review and appeal of decisions by DHEC regarding the permitting of certain animal facilities, other than swine facilities, which are regulated in another section of the Code.The Senate adjourned before giving H. 3929 second reading so it will remain in interrupted debate in the special order slot on the Senate calendar.

Temporary Placement of Children 

A bill to allow temporary placement of a child with a relative or alternative caregiver pursuant to a safety plan but to limit the duration of the safety plan to 90 days with certain exceptions.  The bill sets requirements and duration limits for family and child plans and provides for termination of family preservation services.

Lower Saluda River Trout

A bill to establish a year-round “catch and release” zone on the lower reach of the Saluda River.

 

Turkey Seasons and Limits 

A bill to extend the period in which wild turkey seasons and bag limits for certain counties are suspended, until July 1, 2020.
